Man with HIV/AIDS Sentenced to 15 Years for Aggravated Defilement

Masaka High Court has sentenced a man to 15 years in jail for defiling a 13-year-old girl and infecting her with HIV/AIDS.

Court presided over by Justice Kibuuka Musoke heard that on 19th-December-2010, while the victim’s grandmother was away, the convict came to their home at around 7:00pm and defiled her.

Prosecution led by Mr. Peter Mugisha told court that the convict Geoffrey Masasi (32) a resident of Kisomole village in Rakai district was infected with HIV/AIDS. Medical proof of this was attested to in court by Dr. Watuwa of Rakai hospital who examined the convict.

Prosecution was seeking a maximum sentence of death because the convict had irreparably damaged the victim’s life.

Defense represented by Lawrence Yawe prayed to court for a lenient sentence asking court to consider the period of three years Masasi has spent on remand. They also argued that he had reformed and apologised to the victim’s family.

But given a chance by the judge to address the court, Masasi instead insisted he was not guilty and claimed he had been his victim’s lover.

Justice Kibuuka then concluded that Masasi was not repentant and sentenced him to 15 years.
