The High Court in Fort Portal has fixed Thursday April 4th as hearing date of a suit against Tooro King Oyo Nyimba Kabamba Iguru Rukidi IV.

Last month, King Oyo was sued by George Kusemererwa, a member of the Tooro Kingdom Clan Council, for the suspension of the 1999 Tooro Kingdom constitution. Kusemererwa also argued that the appointment of Stephen Kaliba as Prime Minister shortly after the acrimonious resignation of Amos Mugisa was illegal, as there was no constitution in place.

Last week, through his lawyers of Karuhanga, Tabaro and Associates, King Oyo filed a defense at the Fort Portal High Court, arguing that he suspended the constitution with the approval of the Kingdom parliament, the Orukurato.

King Oyo also denied appointing Steven Kaliba as the Prime Minister saying that he only nominated his name. He asked court to dismiss the allegation saying it is baseless since Kaliba has neither taken an oath nor been installed.

The case will be heard by the Fort Portal High Court Resident Judge, Justice Mike Chibita.

It isn’t yet clear if King Oyo, who is currently in Fort Portal on holiday, will personally appear in court to defend himself.

Since arriving in Fort Portal over the weekend, the 21 year old monarch together with Queen Mother Best Kemigisa and some palace officials have been holding meetings with the Kingdom’s legal team in preparation for the case.

A source working at the Kingdom palace in Fort Portal told Uganda Radio Network that King Oyo was forced to cancel some planned activities during his stay in the kingdom, so as to attend to the legal team.

Last year King Oyo suspended the constitution shortly after he had appointed a legal team to review some of the clauses in the same document.

On February 16, King Oyo appointed Kaliba as Tooro Kingdom premier, days after Amos Mugisa resigned citing influence and financial mismanagement by the palace officials.
