Rally Driver Lwakataka Cleared Of Murder Charges

Rally driver Ponsiano Lwakataka has been remanded to Kalisizo government prison after being charged with interfering with police work.

Lwakataka (42) was charged before Kalisizo Grade One Magistrate Susan Awidi. He was charged along with Abdallah Mukiibi (28) who was similarly remanded.

Prosecution led by Miriam Akite brought four charges against the Mukiibi: assault, causing grievous harm, assault and inciting violence. Lwakatataka was accused of interference with police when police officers were on operation to impound immature fish.

Akite told Court that the Ponsiano Lwakataka on March 3, 2013 at Kanyanoti village in Kyeebe sub county in Rakai District interfered with the work of a police officer No. 4347 Police Constable (PC) Mikidaadi Kabiito who was in an operation of impounding immature fish.

Prosecution alleges that Abudal Mukiibi the same date (March 3, 2013) assaulted a police officer PC- Mikidadi Kabiito on top of inciting violence, causing grievous harm and interfering with his duty.

Both men pleaded innocent to the charges brought against them.

However, the men did not make bail because Awidi demanded for the practicing certificate of the lawyer representing the two men Hassan Kamba of Kamba and Company Advocates.

A frantic Kamba was unable to produce the certificate in time and Awidi decided to remand the suspects.

But speaking to journalists after the hearing, Kamba dismissed the allegations that had linked Lwakataka to the murder of Pastor Steven Mugambe and his family in Kyebe.

Kamba said that Muddu Asuman, the suspect who made the statement implicating Lwakataka, had been influenced.

Kamba said that Muddu had said that on the way to commit the murder, the group had stopped in Kyotera at a Lwakataka hotel. However, he described the man who directed they travel with an extra hand as a short, fat, brown man.

Kamba pointed out that Lwakataka is a very black man and therefore cannot be the man Muddu saw at the hotel.

Lwakataka was re-arrested Wednesday by Police Flying Squad officials on charges of murder, assault and insulting former Rakai Resident District Commissioner (RDC) David Kaboyo. He had just been set free by a Kasese court where he is facing charges of dealing in immature fish.
