Justice Yasin Nyanzi is expected to announce on Friday whether or not he will disqualify himself from hearing the application challenging the KCCA tribunal report.

The KCCA tribunal report led to the controversial impeachment of Erias Lukwago, the Kampala Lord Mayor in November last year. As a result, Lukwago filed a petition in high court for the judicial review of KCCA tribunal report, which is before Justice Yasin Nyanzi.

Recently, Peter Nyombi, the Attorney General asked Justice Nyanzi to disqualify himself from hearing the application for fear that he would be biased and doesn’t expect justice from him. He cited irregularities an earlier interim injunction issued to Lukwago by Fred Waninda, the Deputy High court registrar on behalf of Justice Nyanzi to stop the KCCA meeting to impeach the lord mayor.

The judge may choose to disqualify himself from the case or continue to hear the application. If justice Nyanzi decides to stick on the case, the attorney general will then have to appeal the matter in the court of appeal. In his application among other things wants high court to quash the Justice Catherine Bamugemereire-Tribunal report that found him guilty of abuse of office, misconduct and incompetence.

He argues that the the Bamugemereire-Tribunal, which was constituted to investigate him exhibited bias before the hearing and throughout the entire proceedings. But the attorney general through the minister of Kampala Frank Tumwebaze wants court to dismiss Lukwago’s application arguing that it has been overtaken by events as he was already kicked and there is nothing to save.
